Terms of Service

1. Scope

These terms of service apply to the use of the NextRep app, website, and all related services. By registering or using NextRep, you accept these terms in full. If you do not agree with any part of these terms, please do not use our services.

2. Free Features

The core features of NextRep are permanently free to use. These features may be modified or updated at our discretion, but will remain free for existing users.

3. Premium Subscription

The Premium subscription unlocks additional features: an AI training plan, more AI meal scans (5 per day instead of 3 free scans in total), widgets, individual rest times per exercise, and your own accent color and home screen. Premium can be tried free for 7 days; after that, the subscription renews automatically as a paid subscription unless it is cancelled beforehand through the store.

• Auto-Renewal: Your subscription renews automatically at the end of each billing period unless cancelled
• Cancellation: You can cancel at any time: on iPhone under Settings → [your name] → Subscriptions (Apple App Store), on Android in the Google Play Store under profile picture → Payments & subscriptions → Subscriptions (or in the app via Profile → Manage subscription). Cancellation takes effect at the end of the current billing period
• Refunds: Refunds are handled according to the policies of the respective store (Apple App Store or Google Play). We cannot process refunds directly
• Payment Processing: All payments are processed through the Apple App Store or Google Play. Your payment information is handled by Apple or Google, not by NextRep

4. User Account

• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information during registration
• You must keep your account information up to date
• You agree to notify us immediately of any unauthorized access to your account

5. User Responsibilities and Conduct

You agree not to:

• Share your account with third parties or allow others to use your account
• Use the app for illegal, harmful, or abusive purposes
• Attempt to gain unauthorized access to our systems or other users' data
• Reverse engineer, decompile, or attempt to derive the source code of the app
• Violate any applicable laws or regulations
• Harass, threaten, or harm other users

Violation of these terms may result in account suspension or permanent termination without refund.

6. Health & Medical Disclaimer

NextRep is a fitness tracking and health management tool. The app does not replace professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before starting any new fitness regimen or making significant dietary changes.

The AI-powered features (food scans, training plans) are provided for informational and convenience purposes only and are not personalized medical advice. Results from these features may not be 100% accurate and should be verified.

7. Limitation of Liability

Use at Your Own Risk: NextRep is provided on an "as-is" basis. You use the app entirely at your own risk and assume full responsibility for any health or fitness decisions made based on app data.

No Liability: To the fullest extent permitted by law, NextRep and its creators assume no liability for:

• Injuries, health complications, or adverse outcomes from using the app
• Inaccuracy of AI-generated food scans or training recommendations
• Data loss, corruption, or unauthorized access to your data
• Service interruptions or downtime
• Any indirect, incidental, or consequential damages

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability, so these limitations may not apply to you.

8. Intellectual Property Rights

All content, designs, code, graphics, and technologies in the NextRep app and website are the exclusive property of Moritz Losert and protected by copyright law.

You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. You may not copy, modify, distribute, or reproduce any content without written permission.

9. Third-Party Services

NextRep integrates with third-party services including Apple HealthKit, Health Connect (Android), Strava, OpenAI, and Supabase. Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for their services, data practices, or policies.

10. Modifications and Termination

We reserve the right to modify, update, or discontinue NextRep or any of its features at any time. We will attempt to provide notice of significant changes.

We reserve the right to terminate or suspend your account at any time for violation of these terms or for any other reason, with or without notice.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification. Your continued use of NextRep after changes means you accept the updated terms.

12. Governing Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict of law principles. Any dispute arising from these terms or the use of NextRep shall be subject to the exclusive jurisdiction of the courts of Germany.
